Definitions
Personal Data
Personal Data means data about a living individual who can be identified from that data (or from that data and other information either in our possession or likely to come into our possession).
Usage Data
Usage Data is data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
Cookies
Cookies are small pieces of data stored on a User's device.
Data Controller
Data Controller means a person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any Personal Data are, or are to be, processed.
For the purpose of this Privacy Policy: (1) if you are a Crükus client, we are a Data Controller of your data; (2) if you are a contact of a Crükus client (for example, a customer who chats, texts, or calls a client's AI assistant, or whose information a client gives to us), we are a Data Processor of your data and the client is the Data Controller.
Data Processor (or Service Providers)

We may use the services of various Service Providers in order to process your data more effectively.

Information Collection and Use
We collect several different types of information for various purposes to provide and improve our Service to you.
Types of Data Collected
Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Phone number
- Address, State, Province, ZIP/Postal code, City
- Cookies and Usage Data
We may use your Personal Data to contact you by email with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these emails from us by following the unsubscribe link or instructions provided in any email we send. We do not send promotional or marketing text messages (see "Text Messaging (SMS)" below).
Information Collected by Our AI Digital Business Assistant
Our AI Digital Business Assistant answers web chat and text messages for our clients, and on Growth and Pro plans also answers phone calls. Pro plans add Facebook Messenger (coming soon), Google review requests, win-back emails (coming soon), and lead scoring. The assistant can reply in Spanish. When you interact with a client's AI assistant, we process, on that client's behalf:
- The name, phone number, email address, and other details you choose to share, and what you need help with
- The content of your chat, text, and Messenger conversations
- For phone calls on Growth and Pro plans, an AI-written summary and a transcript of the call. Calls are not recorded. The summary and transcript are saved as a note on the caller's contact record in the client's own customer relationship management (CRM) system.
- Lead details such as a lead score (on Pro plans) and the status of your request
Clients can see this information in their Crükus client portal. At a client's request, lead details may also be sent to the client's own customer relationship management (CRM) system. The client decides how it uses that information under its own privacy policy, so if you are a contact of a Crükus client, please also review that client's privacy policy.
Client Portal Accounts
If you are a Crükus client or a member of a client's team, we collect the information needed to set up and secure your Crükus client portal account, such as your name, email address, and mobile phone number. We may send sign-in codes to your mobile phone by text message.
Virtual Assistant Candidates
If you apply to work as a virtual assistant with Crükus, we collect the information you provide in your application, such as your contact details, work history, and skills, along with the results of our candidate testing. Our testing covers culture fit, English (C1 level) and role-specific tests, using our own set of tests. We use this information to evaluate your application and to match qualified candidates with client roles. We share candidate profiles with prospective clients.
